General terms and conditions of the hotel industry

for weddings

The General Terms and Conditions for the Hotel Industry (AGBH 2006) and the General Terms and Conditions for the Hotel Industry 2016 (AGBG 2016) apply.

The following "SPECIAL CONDITIONS FOR WEDDINGS" at the Natur- und Wellnesshotel Höflehner apply in addition to or as special provisions to the General Terms and Conditions for the Hospitality Industry 2016 (AGBG 2016). Unless expressly agreed otherwise, the bride and groom (the wedding couple) shall be deemed to be the organiser and the invoice recipient jointly and severally. The Natur- und Wellnesshotel Höflehner is hereinafter referred to as the "Hotel" for short.

Cancellation conditions for wedding events:

If the wedding is cancelled up to 6 months before the wedding date, a flat cancellation fee of EUR 1.800.- will be charged. If the wedding is cancelled up to 3 months before the wedding date, 70 % of the agreed arrangement price (menu price as well as all catering for the day for the booked number of persons, wedding package, all other booked services) will be charged, but at least EUR 2,000. In case of cancellation within 1 month before the wedding date or no-show, 90 % of the arrangement price (menu price as well as all catering for the day for the booked number of persons, wedding package, all other booked services) will be charged, but at least EUR 2,500. The AGBH 2006 shall also apply as cancellation conditions for rooms for weddings. All cancellations shall only be accepted in writing. In any case, there is no legal right of cancellation on the part of the organiser pursuant to § 18 para 1 no. 10 FAGG.

Reduction:

A reduction of up to 20% of the number of persons is free of charge with regard to prices or services dependent on the number of persons (e.g. menu price and drinks package, but not flowers, wedding package, etc.) up to 1 month before the event/arrival date. A free reduction of up to a further 5% of the originally agreed number of persons is free of charge with regard to prices or services dependent on the number of persons (see above) up to 1 week before the event/arrival date. In the event of a reduction in the number of persons exceeding this, the organiser shall be charged 50% of the reduced turnover. Irrespective of this, in the event of a reduction in the number of participants of more than 20%, the hotel shall be entitled to recalculate the prices depending on the number of persons and/or to reallocate the rooms. The exact number of participating persons must be announced up to 7 calendar days before the date of the event. This number shall be deemed to be the guaranteed minimum number of participants and shall be invoiced to the organiser. Should more persons participate than this, they will be charged according to the number of persons actually present.

Prices:

All prices quoted include VAT at the statutory rate. However, in the case of long-term reservations, i.e. reservations made more than 6 months before the date of the event, the hotel shall be entitled to adjust prices appropriately in accordance with the market and cost situation.

Payment:

A deposit of EUR 1,800 is payable up to 6 months before the wedding date. In case of late payment, the hotel is entitled to cancel the event date and charge the full cancellation fee. In the event of late payment, the statutory interest on arrears shall also be incurred.

Premises/ duration of event:

The hotel reserves the right to allocate the choice of premises itself according to utilisation and capacity. The event premises may not be sublet by the organiser to third parties. The event premises shall be available on the day of the event as early as 2 hours before the start of the event. The event location must be vacated by 8:00 a.m. on the day following the start of the event. All items not removed will otherwise be removed by the hotel. Excessive effort for this will be charged to the event organiser.

Registry Office:

Music/AKM/ Noise protection:

If music is planned to be performed at the event, the organiser (= the bridal couple) must obtain any necessary registrations with AKM and entertainment tax in good time. If there are overnight guests in the house who do not belong to the event, the music must be turned down to room volume from midnight. From 10.00 p.m. onwards, playing music, etc. is prohibited in the outdoor area. Exceptions are weddings at the Knapplhütte, where the curfew is set at 02.00 hrs. Music can be played until then. If the hotel's own sound system is used, no changes whatsoever may be made to the cabling. In the event of non-compliance, the organiser shall bear the corresponding costs of a specialist company for the restoration. If the registrar wishes to play music during the wedding ceremony, a USB stick with the stored music as MP3 files and the names of the songs with numbers in the desired order of playback must be handed over to the hotel at least 3 days before the event. No other data may be stored on the USB stick.

Catering:

Food and drinks may only be brought to the event by prior arrangement and against payment of a stubbing fee. The organiser shall be liable for his guests in this respect on an undivided basis. On the part of the hotel, a number of staff corresponding to the usual quality standard will be provided. The choice of type, brand and quantity of food and beverages shall be made at the discretion of the hotel within the scope of the usual quality standard. For food hygiene reasons, it is not permitted to take away buffet or food leftovers. It is pointed out that any refrigeration of a wedding cake brought along can only be carried out on the responsibility or by the organiser at a place specified by the hotel and that the hotel accepts no liability whatsoever for damage in transit etc. The wedding cake may only be refrigerated at the hotel's discretion. Refrigeration is possible from 1 p.m. on the wedding day at the earliest.

Additional services:

For all services booked by the hotel on behalf of the client with third parties (e.g. hairdresser, flowers, cake, fireworks), any complaints in this regard must be made to the relevant third party company without recourse to the hotel and do not entitle the client to withhold payment from the hotel.

Photos:

The hotel shall be granted an unrestricted and unlimited licence to use photographs voluntarily provided by the organiser or the photographer commissioned by the organiser for the hotel's advertising purposes, provided that no persons are visible on the photographs . This right also includes the editing of photographs, in particular to make persons unrecognisable. The personal rights are to be protected accordingly.

Pets:

Pets are only allowed at weddings at the Knapplhütte and in the Gumpenbar, with a leash or muzzle attached.

Cleaning:

The organiser shall bear the costs for the removal of any soiling that exceeds the usual extent. In the entire garden area of the event location, the scattering of non-biological substances such as confetti, plastic flowers, etc. is prohibited. No decoration of any kind may be scattered in the entire indoor area and on all paved outdoor areas of the hotel - with the exception of the banquet tables.

Fireworks / Starbursts:

The shooting off of fireworks or the performance of fire shows and other pyrotechnic displays is not permitted. The use of star sprinklers, star throwers, sky lanterns and the like is prohibited at the event location. For the release of balloons or the use of drones, the Organiser shall comply with the relevant statutory provisions and obtain any necessary permits at his own expense. The Organiser shall indemnify and hold the Hotel harmless for any and all damages and consequences arising from such performances.

Decoration / Fire Protection:

The organiser shall observe the hotel's fire protection regulations and, in particular, shall not obstruct any escape routes and shall observe the smoking ban in all rooms. The installation of decorative material etc. is only permitted after consultation with the hotel. We would like to point out that all decorative materials brought in by the organiser must be flame retardant and have low smoke emission. Only easily removable "poster adhesive tape" is permitted for attaching decorative material to walls or ceilings. The hotel's written approval must be obtained in advance for all intended installations, decorations, rearrangements and redesign work.

Supervision of children:

As there is a pond, swimming pool and subsequently a stream on the hotel premises, it is necessary for children to be supervised by an adult throughout the duration of the event and the organiser is responsible for this or must advise parents.

Damages:

All persons commissioned by the organiser or by third parties attributable to the organiser (e.g. witnesses, parents) for the event (e.g. external service providers such as band, wedding planner, photographer or cake suppliers, furthermore also witnesses to the marriage, etc.) must be notified to the hotel at least one week before the start of the event, including address and contact details. The organiser shall be jointly and severally liable for any damage caused by his guests, employees, agents etc.. In individual cases, the hotel may require the organiser to take out suitable insurance or prohibit the involvement of external service providers or suppliers in the event. The statutory warranty regulations shall apply.
